Terms and Conditions

When you make your booking, you are entering into a legal agreement with us. Please read our terms and conditions of booking below.

In these terms and conditions, “you” and “your” means all persons named on the booking (including anyone who is added or substituted later). “We”, “us” and “our” means Blue Marin Apartments, Didim.

Once a booking is accepted from any source (eg: this site, booking.com, AirBNB etc) it is your responsibility to provide us with the full names and passport numbers for all guests in your party. Registration of guests with the Turkish authorities is a legal requirement. Failure to comply results in a fine of TRY 16,000 (approx £800 or €880) for both ourselves and all adults not registered – this is payable immediately.

Please note that you are responsible for any errors in the booking, eg: the wrong number of guests, wrong dates, wrong flight details, etc. Indirect bookings must be corrected via the booking company eg: booking.com, AirBNB etc. Direct bookings via this site can be amended by contacting us and paying any applicable adjustment fee.

Arrival and Departure

Access to the apartment is available from 3.00pm (15:00) on the day of arrival. Check-in times outside of those specified must be confirmed with us prior to arrival.

We ask that you please vacate your room by 12.00pm (midday) on the day of departure.

Reservations

When booking through a third party please note the cancellation policy before committing to a reservation.

If booking direct we ask for a non-refundable deposit of 25% of the booking, payable as soon as the booking is confirmed by us. The 75% balance is due 8 weeks before arrival and is non-refundable. We advise you to take adequate travel cancellation insurance.

Cancellation by the Guest

We are a small business, so cancellations can have a big impact on us, especially if we have turned away potential guests in favour of someone who has already booked and who then cancels.

For direct bookings no refund will be offered for cancellations, no-shows and early departures.

Changes or amendments to the reservation will be termed as cancellations and no refund will be offered.

We take all Bookings in good faith, as we are unable to judge reasons for change, cancellation or non-arrival, guests are reminded that no exceptions to the above conditions will be made and that any booking made with us for forms a legally binding contract. For this reason, we advise that you take out a suitable insurance product to cover against unexpected costs such as cancellation fees. In addition, we may take legal action, through the Courts, to recover any outstanding debts.

Cancellation by Us

Should it become necessary for us to cancel a booking we will contact you immediately. If the cancellation is due to non-provision of guest details and passport numbers, no refunds will apply. Otherwise payments made will be refunded in full. Should you wish to, we will attempt to book you into another local apartment of the same or lower grading in a similar standard of room(s). Should this establishment be more expensive than Blue Marin Apartment, we will pay the difference for the first night of your stay. Our liability will not extend beyond these conditions.

Car Parking

Car parking is available for guests. Cars are parked at owner’s risk.

Conditions of Stay

We have some standard rules that are designed to ensure that we comply with regulations relating to matters such as fire, health and safety, and to enhance the comfort and well-being of guests. We reserve the right to terminate your booking immediately without being liable for any refund or compensation where you engage in unacceptable behaviour that causes a disturbance or nuisance to other guests. In such circumstances, any outstanding account must be settled.

Damage and Breakages

Please take care of our home and properties. You are responsible and liable for any breakages or damages which you cause to the accommodation or its contents. Please report these as soon as they occur especially if you accidentally spill something – it’s much easier to clean if we know what it is and act quickly. We do not normally charge for breakages, but we reserve the right to charge for repair or making good if the damage is significant.

Force Majeure

Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of “force majeure”. In these Booking Conditions, “force majeure” means any event which we could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, terrorist activity or actual threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, contagious diseases and all similar events outside our control.

For reservations under Force Majeure, where guest have the inability to stay as intended. We will seek to arrange in this order:

Substantial changes and cancellation by client

A “substantial change” means a change of date, a change to duration of stay or number of guests or Arrival/Departure date changes.

Any substantial change to or cancellation of a booking must be notified verbally and then in writing. Notice of cancellation or substantial change will only be effective on the working day that it is received in writing. A working day is any day Monday to Friday other than bank and public holidays.

Where any change or cancellation changes the number of group members, we will recalculate the cost of the arrangements and re-invoice you accordingly.

Insurance

You are strongly recommended to take out personal travel insurance for all members of your party. Please note that not all insurance policies intended for travel overseas are adequate to cover you for the stays featured on our website. It is your responsibility to ensure that the insurance cover you purchase is adequate for your needs. We do not check insurance policies.

Keys

You have access to the building and your room 24 hours a day throughout your stay using a set of keys given to you when you register on arrival. You have full responsibility of these keys for the duration of your stay. Lost keys will be charged at £40.00 per set plus any additional costs incurred if any additional work is required, such as, locks having to be changed.

Liability

We do not accept any liability for any damage, loss or injury to any member of your party or any vehicles or possessions, unless proven to be caused by a negligent act by ourselves or our employees during the course of their employment.

Lost Property

We are happy to return items that have been left following departure. However, there will be a charge to cover postage and packaging.

Missing Items

We reserve the right to charge for missing items. Personalised mugs, coasters, place mats are provided at the apartment. Please do not remove these from the property – if you contact us we can put you in touch with the company who personalises these items. Thank you.

Payment

For direct bookings the full balance of Payment is due by bank transfer or PayPal 6 weeks before arrival, with a 20% deposit required to secure the booking.

Prices

We reserve the right to change our prices at any time. This does not affect bookings already made.

Smoking

Smoking, including the use of e-cigarettes, is NOT permitted within any part of the establishment. This includes the outside terrace area. Please note that offending guests may be asked to leave immediately and may be liable for professional cleaning of any rooms and any outstanding balance of nights booked but not taken through early departure.

Other house rules

Termination Policy

We reserve the right, at our discretion, to terminate, without notice, an individual’s stay where deemed necessary through unacceptable behaviour or as a result of actions which are likely to endanger or offend others (Please note that non-compliance of our non smoking policy may constitute termination). In such circumstances any outstanding account must be settled, no refunds will be made.

Wi-Fi Access

By using our Wi-Fi Service you agree to the terms and conditions of use in force at the time. 

We reserve the right to amend these terms and conditions at any time.

You acknowledge and agree that all intellectual property rights (including, but not limited to, copyrights (including rights in software), trademarks, database rights, patents and inventions) in and relating to the service are owned by us and our licensors or contractors. Nothing in this agreement operates to transfer any such intellectual property rights to you.

We reserve the right to assign or sub-contract any of our rights and obligations under this agreement without notice to you.

If any provision of this agreement is found to be unenforceable by a court of competent jurisdiction, the other provisions shall nevertheless remain in full force and effect.

This agreement is governed by the laws of England and the parties hereto submit to the non-exclusive jurisdiction of the English courts.
